Your use of the website (“Our Site”), Our App (“Our App”) and Our Telephone Booking Service (collectively ” Our Booking Services “) is subject to these terms and conditions together with any additional terms and policies referred to in them (“Our Terms”).

These terms and conditions of service together with any terms and policies referred to in them constitute a legally binding agreement between you and Glowify Ltd. Our Terms govern your use of this website and also our App and our telephone booking services. By using our Site or Booking Services, you agree to abide by these terms.

Please read Our Terms carefully and thoroughly. If you do not accept Our Terms, you must not make a booking for any make-up service (“the Services”).

1. Eligible Use

Our Site and Site Services are intended solely for persons who are 18 or older. Any access to or use of our Site or Services by anyone under 18 is expressly prohibited. By accessing or using our Site or Services you represent and warrant that you are 18 or older.

1. The Service

When booking a beauty service, Glowify Ltd acts as a booking agency for self-employed Beauty Professionals. Our contract with you is limited to the provision of use of our Website.

Glowify Ltd provides a Booking Services for a range of make-up treatments that are performed in each and every case by an independent self-employed professional make-up artist (“Independent Make-up Artist”). In providing this booking service, Glowify acts as the agent of these Independent Make-up Artists. Glowify has no responsibility for any make-up services which you book through us: we are simply involved with the booking process.

Your Independent Make-up Artist is responsible for providing the Services to you and you have a direct contract between you and the Independent Make-up Artist concerning the provision of Services. This contract does not include us. You and the Independent Make-up Artist are responsible for any taxes arising as a result of the Services.

Whilst Glowify reviews all Applications and assesses Independent Make-up Artist who wish to provide these Services, we do not guarantee or warrant, and make no representations regarding the reliability, quality or suitability of Independent Make-up Artist. This is entirely a matter for you. Accordingly, you acknowledge and agree that Glowify does not have any obligation to conduct any background checks on any Independent Make-up Artist and have no obligation in respect of any service they may provide.

When interacting with any Independent Make-up Artist you should exercise caution and common sense to protect your personal safety, details and property, just as you would when interacting with other persons who are unknown to you.

1. Booking Process

By making a booking through our website or over the phone, you warrant that you agree to provide complete, correct and true information including billing and payment information.

After placing a booking, you will receive an email from us acknowledging that we have received your booking. Please note that this does not mean your booking has been accepted. If your booking is within 48 hours you will receive any applications for your booking as and when they are received from the Independent Make-up Artist. If your booking is more than 48 hours away you will receive all of the applications for your booking after 4 hours. Once you have received application(s) for your booking, it is then your decision which Independent Make-up Artist you choose and you must accept the booking for this booking to be confirmed.

The Contract between you and the Independent Make-up Artist will only be formed when you confirm and book the Artist for the appointment.

You agree that you will not seek to book any Services from any said Independent Make-up Artist other than via Our Site or Our App for the duration of this agreement and in the 3 months after the termination of this agreement.

1. Price and Payment

Full payment is due at the time of booking the Service with the Independent Make-up Artist other through us.

Prices vary according to type and duration of Service as described on the App.

All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via Verified by Visa.

By making a booking you agree to provide complete, correct and true information including billing and payment information.

All Service Fees are payable through Our Site, Our App or over the telephone as part of our telephone booking service.

We have an agreement with each Independent Make-up Artist under which we are entitled to charge them a monthly fee for using our Booking Services portal. The monthly fee entitles the Make-up Artist to compete 3 Glowify jobs. One booking is equal to one job. In the instance where more than one person is in the appointment, each person will be the equivalent to one Glowify job.

1. Customer Responsibilities

In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Independent Make-up Artist to provide the Service as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation.

1. Cancellation & Refunds

You acknowledge that you do not have any statutory right to cancel a booking made for a Make-up Service. However, you have a contractual entitlement to cancel any booking you have made with an Independent Make-up Artist through us in the following circumstances and on the described terms.

You may cancel a confirmed booking at any time via the app or by contacting us at hello@glowify.app.

Client Cancellation

• You can cancel free of charge within 10 minutes of making a booking, for example if you have selected an incorrect time slot by mistake.
• Less than 24 hour’s notice. Any cancellations made within or less than 24 hours of your confirmed booked appointment shall incur a cancellation charge of 100% of the cost of the Service.
• Rescheduling appointments. The cancellation charge will be waivered if you if you reschedule your booking with the same make-up artist more than 12 hours in advance of the make-up appointment. (Please note the rescheduled booking cannot be cancelled within 10minutes of amending the booking).

Make-Up Artist Cancellation

• Less than 24 hour’s notice.
  • The first time this happens within a 12-month period, Glowify will honour the cancelation as extenuating circumstances.

• • If it happens a second time within the same 12- month period, Glowify will remove 2 stars from the Independent Make-up Artist’s star rating and a review will be added to their profile stating that the Independent Make-up Artist cancelled a job.
  • Should it happen on a third occasion within the same 12-month period, Glowify will remove the Independent Make-up Artist from the site.
  • Make-up artists who have been removed will no longer appear on the app.

A cancellation fee is charged in order to compensate the Independent Make-up Artist because it is not reasonable to expect that Independent Make-up Artist to be able to provide Make-up at another booking where you cancel with short or no notice.

Cancellation fees may in our absolute discretion be waived where you have been unable to cancel a booking without incurring the cancellation fee for genuine reasons which were outside of your control. Where cancellation fees are waived by us, we act as agent of the Independent Make-up Artist who is the principal in supplying the Make-up Services.

If you violate any of the Terms, your permission to use the Services and Website will automatically terminate.

We reserve the right to cancel any Booking without notice or cause.

1. Promo Codes and Referrals

We may from time to time create and offer promotional codes and referral codes (together “Codes”) that can be redeemed on the Site against purchases of Make-up Services. Codes will only be valid for a period of time stated on or with them.

Promo Codes do not have any cash value.

Discounts cannot be used in conjunction with any other offers or discounts.

Customers deemed to be abusing the terms of these promotional credits will have credits removed from their account and/or their account closed.

1. Client Conduct

We request that you treat all Independent Make-up Artist’s with courtesy and respect and that you provide them with a safe, clean and appropriate location to perform the Services. Independent Make-up Artist’s shall be entitled to refuse to perform Services in the event that you have not provided a safe, clean and appropriate location for them or you behave towards them in a manner which is discourteous, disrespectful, abusive or otherwise inappropriate. We reserve the right to withhold access to the Site Services at our absolute discretion in the event that you behave towards any Independent Make-up Artist’s in a manner which is discourteous, disrespectful or abusive or which we otherwise deem to be inappropriate.

1. Intellectual Property

Glowify, the Glowify logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with the Site, App or the Services (whether registered or unregistered) belong to us or our licensors (as are applicable) and are protected by intellectual property law. Nothing in these Terms grants you any rights in the Site, App or Booking Services or the content within the same. All rights are reserved.

1. Accuracy of Information and Availability of the Site

While we try to make sure that the Site is accurate, up-to-date and free from bugs, we cannot promise that it will be. Furthermore, we cannot promise that the Site will be fit or suitable for any purpose. Any reliance that you may place on the information on this Site is at your own risk. We may suspend or terminate operation of the Site at any time as we see fit. Any Content is provided for your general information purposes only and to inform you about us and our services and other websites that may be of interest. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. While we try to make sure that the Site is available for your use, we do not promise that the Site is available at all times nor do we promise the uninterrupted use by you of the Site.

1. Disclaimer

As noted above, we introduce individuals seeking Make-up Services to Independent Make-up Artist’s seeking to provide such Make-up Services. We are not liable or responsible for the fulfilment of any booking or the performance of the Independent Make-up Artist’s. You acknowledge and agree that we are not responsible for addressing any claims you have as regards any Independent Make-up Artist’s or any Make-up Services, however we do try to assist by providing the intermediary services around resolving disputes and complaints as mentioned above.

Content on Our Site and Our App which is made available as part of Our Booking Services is provided for your general information purposes only. Nothing contained on Our Site, Our App or communicated any other way as part of Our Booking Services constitutes, or is meant to constitute, advice, opinion or guidance of any kind. We are not a health care provider nor do we provide medical advice or medical treatment. References in Our Site, Our App and elsewhere to “Treatment” and “Therapy” or any similar terms do not refer to medical treatment or medical therapy. The information presented on Our Site and otherwise as part of Our Booking Services is not intended to diagnose health problems or to take the place of professional medical care. Should you have a medical issue you should always consult with a qualified medical professional.

We make no warranty or guarantee that Our Site, Our App or any other aspect of Our Booking Services is suitable for your intended use, error-free, timely, reliable, entirely secure, virus-free or available. We make no guarantee of particular results or outcomes by use of Our Site, Our App or any other aspect of Our Booking Services.

Nothing in Our Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit and nothing in Our Terms will exclude or limit our liability in respect of any: death or personal injury caused by the negligence of Glowify, fraud or fraudulent misrepresentation by Glowify, or any matter which it would be illegal or unlawful for Glowify to exclude or limit, or to attempt or purport to exclude or limit, its liability.

We are not liable or responsible for any errors in or failure to provide Our Booking Services due to your error or failure to provide accurate and complete information

Whilst we make every effort to ensure that Our Booking Services are available, we do not represent, warrant or guarantee in any way the continued availability at all times or the uninterrupted use by you of Our Booking Services. We reserve the right to suspend or cease the operation of all or part of Our Booking Services from time to time at our sole discretion.

1. Limitation of liability

By using our Site, our App or our Service, you agree to hold Glowify Ltd free from liability or responsibility for any damage that might arise out of the transaction between you and our Site, our App or any Independent Make-up Artist’s.

Glowify Ltd. makes no representations or warranties in connection with our Site or our App, whether express or implied, including but not limited to warranties of satisfactory quality, non-infringement or fitness for a particular purpose, except to the extent such warranties are not legally excludable.

Use of our Site and our Site Services is on an “as-is” and “as available” basis. In no event shall we be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, loss of data, lost revenues, loss of goodwill, loss of anticipated saving or profits, or arising out of or in any way connected with the use or performance of our Site, our Site Services or Independent Make-up Artist’s Services, or with the delay or inability to use the Site, Site Services or Independent Make-up Artist’s Services, or with the provision of or failure to provide the Site, Site Services or Independent Make-up Artist’s Services. Nothing in these Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in these Terms will exclude or limit our liability in respect of any: death or personal injury caused by the negligence of Glowify, fraud or fraudulent misrepresentation by Glowify, or any matter which it would be illegal or unlawful for Glowify to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Indemnity

You agree to defend and indemnify us from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, that arise from or relate to your use or misuse of, or access to Our Booking Services and otherwise from your violation of Our Terms.

By accepting Glowify’s Terms you also accept Glowify App Ltd’s Privacy Policy.
